Online Scheduling Terms of Service
Effective Date: January 1, 2025
1. Acceptance of Terms
By using the online scheduling system on www.mosaiccounseling.com, you agree to these Terms of Service. If you do not agree, please do not use the scheduling system.
2. Eligibility
Mosaic Counseling provides services to:
- Adults aged 18 and older.
- Minors aged 14 years or older, who may independently request and receive outpatient mental health services without the consent or knowledge of a parent or guardian, in accordance with Michigan Compiled Laws § 330.1707.
Note: This does not include:
- Prescription of psychotropic medications
- Inpatient hospitalization
- Pregnancy termination referral services
Services under this provision are limited to 12 sessions or 4 months, whichever comes first. Continued treatment beyond this period requires parental consent or court authorization.
3. Scheduling and Cancellations
- Appointments are subject to availability.
- You may cancel or reschedule appointments up to 24 hours in advance.
- Repeated no-shows or late cancellations may result in limited access to future scheduling.
4. Use of Information
Information you provide during scheduling is used solely to coordinate services and is protected under HIPAA and Michigan law.
5. Technology Disclaimer
While we strive to maintain secure and reliable systems, Mosaic Counseling is not liable for technical issues, outages, or data breaches beyond our control.
6. Modifications
We reserve the right to update these terms at any time. Continued use of the scheduling system constitutes acceptance of any changes.
HIPAA & Confidentiality Disclosure
Mosaic Counseling is committed to protecting your privacy and the confidentiality of your health information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and the Michigan Mental Health Code.
What Information We Collect:
- Name, contact details, and demographic information
- Reason for referral and mental health history
- Scheduling and service usage data
How We Use Your Information:
- To coordinate and provide mental health referral services
- To communicate with you about appointments and services
- To comply with legal and regulatory obligations
Your Rights:
- You have the right to access and request corrections to your health information.
- You may request restrictions on certain uses or disclosures.
- You may request a copy of this notice at any time.
Special Notice for Minors (Ages 14 and Older)
Under Michigan law (MCL § 330.1707), minors aged 14 years or older may independently consent to and receive outpatient mental health services without the consent or knowledge of a parent or guardian.
Key Provisions:
- Scope: Applies only to outpatient mental health services.
- Exclusions: Does not include:
- Prescription of psychotropic medications
- Inpatient hospitalization
- Pregnancy termination referral services
- Duration: Services may be provided for up to 12 sessions or 4 months, whichever comes first. After that, parental consent is required unless continued treatment is court-authorized.
- Confidentiality: Your information will remain confidential unless:
- There is a substantial probability of harm to yourself or others.
- You consent to involve a parent or guardian.
- Disclosure is required by law (e.g., suspected abuse or neglect).
Promoting Family Support
While confidentiality is respected, Mosaic Counseling encourages minors to involve a trusted adult when possible, and services will be provided in a way that supports family relationships and values, as required by law.
